1. Agreement to These Terms
These Terms of Service (“Terms”) govern your use of the UrHealth mobile application, paired UrHealth environmental monitoring device, websites, and related services (collectively, the “Services”) provided by Bionic Environment Solutions Private Limited (“Bionic Environment Solutions”, “UrHealth”, “we”, “us”, or “our”).
By creating an account or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services. Mandatory consumer rights that cannot lawfully be excluded or limited remain unaffected.
2. About UrHealth
UrHealth is designed as a consumer environmental exposure and general wellness information product. The Services may allow you to view PM2.5, PM10, PM1, temperature, humidity, and noise readings; view exposure history and trends; log symptom check-ins; maintain a personal health profile; configure in-app alerts and reminders; monitor authorized dependent profiles; export data; and optionally contribute irreversibly anonymized data to research. UrHealth also includes a planned feature for sending automated exposure updates by email to designated recipients; that email-delivery feature is not currently active.
Features and hardware availability may vary by device, operating system, country, product version, subscription, service configuration, and applicable regulatory approvals.
3. Eligibility and Accounts
If you are under the age at which you can legally agree to these Terms or consent to the processing of your personal information in your country or region, you may use UrHealth only with the involvement and authorization of a parent or legal guardian where required by applicable law. UrHealth does not currently perform technical age verification at account sign-up.
You are responsible for providing accurate information, protecting your credentials, and activity occurring through your account. Where email verification is required, full access may depend on successful verification. Notify us promptly if you believe your account has been compromised.
4. Limited Licence
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to use the UrHealth software for your own lawful use of the Services. Except as permitted by applicable law, you may not copy, modify, distribute, sell, lease, circumvent security controls, or reverse engineer the Services.
5. Health and Medical Disclaimer
UrHealth and its Services are intended as consumer environmental exposure and general wellness tools. Unless a particular feature is expressly identified as having received applicable medical-device or other regulatory authorization, UrHealth is not intended to function as a medical device or to diagnose, treat, cure, prevent, or clinically monitor any disease or medical condition.
Environmental readings, symptom records, wellness guidance, risk indicators, notifications, and alerts are informational tools and are not a substitute for professional medical advice, diagnosis, treatment, or clinical judgment. Do not disregard or delay professional medical advice because of information provided by UrHealth.
If you have questions about a medical condition, symptoms, medication, pregnancy, a child, an older adult, or another vulnerable person, consult an appropriately qualified healthcare professional.
6. No Emergency or Life-Safety Monitoring
UrHealth is not an emergency detection, emergency response, fire alarm, smoke alarm, medical alarm, occupational-safety monitoring system, or other life-safety service. Do not rely on UrHealth to detect or respond to an emergency.
Alerts and notifications may be delayed, unavailable, inaccurate, or not delivered because of sensor limitations, calibration, placement, battery state, Bluetooth or internet connectivity, phone settings, software behaviour, service outages, or other factors. If you believe an emergency exists, contact the appropriate local emergency service or qualified professional without waiting for an UrHealth alert.
7. Device Readings and Accuracy
Environmental sensor readings may be affected by sensor tolerances, calibration, placement, airflow, environmental conditions, contamination, device age, maintenance, connectivity, and other technical factors. Unless expressly stated otherwise, readings are not certified for regulatory, legal, clinical, emergency-response, industrial-hygiene, or occupational-safety compliance.
Any accuracy specifications or performance claims published for a particular UrHealth device are subject to the stated test conditions, tolerances, calibration requirements, and limitations. You are responsible for using the device according to applicable instructions.
8. Health Profiles, Dependents, and Other People
If you create a profile or enter information for another person, including a child, parent, partner, family member, or person in your care, you represent that you are legally authorized to do so or have obtained any consent required by applicable law. You are responsible for the accuracy of information you enter and for removing or updating information when your authority or consent ends. UrHealth does not independently verify family, guardianship, caregiving, or other relationships.
9. Automated Alert Recipients
UrHealth may in future allow you to designate another person, such as a family member or caregiver, to receive automated exposure updates by email. This email-delivery feature is not currently active. If introduced, you must have permission or another lawful basis to provide the recipient’s contact information and cause the communications to be sent. Automated alerts will be informational only, will not be guaranteed to be timely or delivered, and must not be relied upon as an emergency notification system.
10. Research Data Contribution
Research sharing is optional and off by default. You may stop future contributions by disabling the feature. Data already contributed is irreversibly anonymized and cannot be attributed back to your account, individually retrieved, or deleted on an individual basis.
If UrHealth later conducts or participates in formal clinical research, regulated human-subject research, or another study requiring ethics or regulatory oversight, that study will be subject to separate information, consent, governance, eligibility requirements, and approvals as applicable.
11. Your Data and Data Export
As between you and UrHealth, you retain your rights in personal information, symptom information, and environmental measurements generated by your UrHealth device and associated with your account. You authorize UrHealth to process that information only as necessary to provide, secure, maintain, and improve the Services as described in the Privacy Policy or as otherwise specifically authorized by you.
UrHealth may allow you to generate CSV, PDF, or other exports. Once you save or share information outside the Services, you are responsible for choosing the recipient and for how the exported information is stored, transmitted, or further shared.
12. Third-Party Services
Account-verification emails are sent through our authentication provider, Firebase Authentication, using UrHealth’s verified sending domain. Your use of independent third-party services may also be subject to their terms and policies.
We do not control independent third-party services and cannot guarantee their continuous availability, except to the extent responsibility cannot be excluded under applicable law.
13. Acceptable Use
- Use the Services only for lawful purposes.
- Do not misrepresent your identity, authority, or another person’s identity.
- Do not provide another person’s personal or health information without appropriate authority or consent.
- Do not bypass, disable, defeat, or interfere with authentication, database rules, anonymization safeguards, security controls, or access restrictions.
- Do not introduce malicious code or interfere with the availability or integrity of the Services.
- Do not reverse engineer or extract source code except to the extent such restriction is prohibited by applicable law.
- Do not use UrHealth readings as certified regulatory, occupational-safety, clinical, or emergency-response measurements unless the applicable product or feature is expressly authorized for that purpose.
- Do not use the Services in a way that infringes the rights of UrHealth, another user, or a third party.
14. Intellectual Property
UrHealth software, product design, branding, logos, documentation, graphics, and UrHealth-created content are owned by Bionic Environment Solutions Private Limited or its licensors and are protected by applicable intellectual-property laws. These Terms do not grant you rights to our trademarks, logos, or branding beyond the limited right to use the Services.
15. Service and Hardware Availability
We may modify, update, maintain, suspend, or discontinue features where reasonably necessary for security, legal compliance, product improvement, technical reasons, or business operations. We do not guarantee that every feature will always be available or that the Services will operate without interruption or error.
The UrHealth app may be made available in countries where the associated physical device is not yet offered or certified for sale. Hardware will be marketed or supplied only in jurisdictions where Bionic Environment Solutions determines that applicable product, radio, safety, import, and other regulatory requirements have been met. Where a change materially affects paid services or mandatory consumer rights, we will provide any notice, refund, remedy, or other protection required by applicable law.
16. Suspension and Termination
You may stop using UrHealth and request deletion of your account at any time. We may restrict, suspend, or terminate access where reasonably necessary because of a material violation of these Terms, unlawful or abusive activity, a security risk, legal requirements, or discontinuation of the Services.
Where appropriate and legally required, we will provide notice or an opportunity to remedy a violation before termination. Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability provisions, and dispute terms, will continue to apply.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis. We do not promise that the Services will be uninterrupted, error-free, completely secure, or suitable for every purpose, or that every sensor reading, alert, forecast, recommendation, or output will be accurate or timely.
Nothing in these Terms excludes warranties, guarantees, conditions, or remedies that cannot lawfully be excluded under applicable consumer law.
18. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.
To the maximum extent permitted by applicable law, Bionic Environment Solutions Private Limited and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profits, revenue, opportunity, goodwill, or data, arising from or related to use of the Services.
To the maximum extent permitted by applicable law, we are not responsible for loss arising solely from reasonable reliance on an environmental reading, alert, notification, wellness indicator, or other informational output where the limitation or inaccuracy was caused by factors outside our reasonable control, including sensor placement, calibration, connectivity, user settings, third-party infrastructure, or device conditions.
19. Responsibility for Misuse
To the extent permitted by applicable law, you are responsible for losses or claims arising from your unlawful misuse of the Services, your unauthorized provision of another person’s information, or your material violation of these Terms. This provision does not reduce any non-waivable consumer right or shift responsibility for matters for which UrHealth is legally responsible.
20. Governing Law and Disputes
These Terms are governed by the laws of India, without prejudice to mandatory consumer-protection, privacy, or other rights that apply to you under the law of your country or region of residence.
Subject to mandatory local law, courts with jurisdiction in Ahmedabad, Gujarat, India will have jurisdiction over disputes arising from these Terms. Nothing in this section prevents a consumer from using a local court, regulator, alternative dispute mechanism, or statutory remedy where applicable law gives the consumer that right.
Before commencing formal proceedings, we encourage you to contact us so we can attempt to resolve the issue informally.
21. Changes to These Terms
We may update these Terms to reflect changes in the Services, law, technology, or business practices. We will update the “Last updated” date and, where required or appropriate, provide notice of material changes. If applicable law requires your consent to a change, the change will not apply until the required consent is obtained.
22. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of that provision. These Terms, together with the Privacy Policy and any additional terms presented for a specific feature, constitute the agreement governing your use of the Services.
You may not assign your account or rights under these Terms without our consent. We may assign these Terms in connection with a corporate reorganization, merger, acquisition, financing, or transfer of the relevant business, subject to applicable law.
Neither party will be responsible for delay or failure caused by events beyond its reasonable control, except for obligations that applicable law does not permit to be excused.
